    Steps in the Mediation Process

    Wondering how does mediation work? Here’s a step-by-step overview of the mediation process:


    1. Agreement to Mediate

    Both parties agree to resolve the dispute through mediation, either voluntarily or by court recommendation.

    2. Pre-Mediation Preparation

    Each party gathers documents, reviews their position, and may consult with an attorney. Some mediators offer a pre-mediation questionnaire to streamline the process.

    3. Opening Statements

    At the start of the session, the mediator explains the rules. Each side briefly presents their view of the conflict.

    4. Private Breakout Rooms

    The Parties will be assigned their ow private break out rooms with their attorney present (if they have any attorney).  

    5. Negotiation

    The mediator guides both parties through problem-solving, identifying shared interests, and narrowing differences.

    6. Resolution or Agreement

    If a resolution is reached, the mediator may help draft a written settlement agreement. If not, the case can still proceed to court.
